Trendy Fabrics Terms of Service

These Terms of Service (“Terms”) govern your use of TrendyFabrics.net and the products and services provided by Trendy Fabrics LLC (“Trendy Fabrics,” “we,” “us,” or “our”).

By accessing our website, creating an account, placing an order, uploading artwork, or otherwise using our services, you agree to these Terms.

Online Store Terms

You may use our website and services only for lawful purposes and in accordance with these Terms.

You are responsible for providing accurate and complete information when placing an order, creating an account, uploading artwork, or communicating with Trendy Fabrics.

We reserve the right to refuse service, cancel orders, limit quantities, or restrict access to our services when reasonably necessary to prevent fraud, abuse, unlawful activity, or violations of these Terms.

Products and Custom Printing

Trendy Fabrics provides custom-printed fabric and related textile products.

Because many of our products are manufactured specifically for each customer's order, variations may occur between what is displayed digitally and the finished physical product. Differences may result from fabric composition, texture, stretch, printing processes, color profiles, monitors and displays, lighting, dye sublimation, production conditions, or other factors inherent to textile manufacturing.

We make reasonable efforts to produce orders accurately according to the information and artwork submitted by the customer.

Customer Artwork and File Responsibility

You are responsible for reviewing and submitting the correct artwork, dimensions, scale, orientation, repeat settings, print size, fabric selection, quantity, and other order specifications before completing your purchase.

The preview and ordering tools provided by Trendy Fabrics are intended to assist with configuring an order but do not replace the customer's responsibility to verify the submitted artwork and specifications.

Image quality is affected by factors including source resolution, artwork dimensions, scaling, compression, and the quality of the original file. Trendy Fabrics cannot restore detail that is not present in the source artwork.

Rights to Uploaded Artwork

By uploading or submitting artwork to Trendy Fabrics, you represent and warrant that you own the artwork or have all rights, licenses, permissions, and authority necessary for Trendy Fabrics to reproduce and use the artwork to manufacture and fulfill your order.

You retain your ownership rights in artwork you submit.

You grant Trendy Fabrics a limited license to access, reproduce, process, resize when requested by the ordering workflow, store, transfer, and otherwise use submitted artwork as reasonably necessary to provide the products and services you request, including production, order fulfillment, customer service, troubleshooting, and quality control.

You agree not to submit artwork that infringes copyrights, trademarks, privacy rights, publicity rights, or other rights of another person or entity.

Trendy Fabrics may refuse or cancel an order involving content that we reasonably believe is unlawful or infringes the rights of others.

Google Drive and Third-Party File Services

Our ordering tools may allow you to connect third-party file-storage services, including Google Drive, to select artwork for an order.

Connecting a third-party service is optional.

When you choose to connect Google Drive, our ordering tool may request read-only access necessary to browse your Drive folders and supported artwork files and retrieve the artwork file you select.

Trendy Fabrics does not use this access to create, modify, rename, or delete files in your Google Drive.

Once you select a file, that file may be transferred into Trendy Fabrics' order, storage, and production systems so that we can provide the products and services you requested.

Your use of Google and other third-party services may also be subject to the terms and privacy policies of those providers.

Orders and Payment

Prices, promotions, product availability, and other store information may change without notice.

You agree to provide current, complete, and accurate purchase and account information for orders placed with Trendy Fabrics.

Orders are not considered complete until required payment has been successfully processed or otherwise arranged with Trendy Fabrics.

We reserve the right to correct pricing, product, technical, or typographical errors and to cancel or modify affected orders when reasonably necessary.

Shipping and Delivery

Shipping estimates are estimates and are not guarantees unless explicitly stated otherwise.

Delivery times may be affected by carriers, weather, holidays, address issues, customs, service disruptions, or other circumstances outside Trendy Fabrics' control.

Customers are responsible for providing an accurate and deliverable shipping address.

Additional shipping terms or policies displayed on our website at the time of purchase may apply to your order.

Returns, Reprints, and Order Issues

Custom-printed products are produced according to customer-submitted specifications and may not be eligible for return solely because the customer changes their mind, selects an incorrect option, or submits incorrect artwork or specifications.

If you believe your order has a manufacturing defect, printing error, incorrect item, damage, or another issue attributable to Trendy Fabrics, contact us promptly with your order information and supporting photographs or other requested information.

Applicable return, refund, replacement, and reprint conditions are described in our Return and Refund Policy and other store policies.

Website and Ordering Tools

We attempt to keep our website and ordering tools available and accurate, but we do not guarantee that they will always operate without interruption, delay, or error.

We may modify, maintain, replace, suspend, or discontinue website functionality when reasonably necessary.

If you encounter an apparent error while configuring a custom order, you should contact Trendy Fabrics before completing the purchase if the error could affect the product being ordered.

Intellectual Property

Except for customer-submitted artwork and third-party materials, the Trendy Fabrics website and its content, branding, software, text, graphics, interfaces, and other materials are owned by or licensed to Trendy Fabrics and are protected by applicable intellectual-property laws.

Nothing in these Terms grants you ownership of Trendy Fabrics intellectual property.

Prohibited Uses

You may not use our website or services to violate applicable law; infringe intellectual-property or other rights; distribute malicious software; interfere with website security or operation; attempt unauthorized access to systems or accounts; commit fraud; or otherwise misuse our services.

Disclaimer of Warranties

To the extent permitted by law, our website and services are provided on an “as available” basis.

Nothing in these Terms excludes warranties, rights, or remedies that cannot lawfully be excluded.

Limitation of Liability

To the maximum extent permitted by applicable law, Trendy Fabrics will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our website, products, or services.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Trendy Fabrics LLC and its owners, employees, contractors, and service providers from claims, losses, liabilities, and reasonable expenses arising from artwork or other content you submit, your violation of these Terms, or your violation of another party's rights.

Governing Law

These Terms are governed by the laws applicable to Trendy Fabrics LLC in the State of Oklahoma, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, business practices, technology, or legal obligations.

The “Last updated” date will indicate when these Terms were most recently revised.

Continued use of our services after updated Terms become effective constitutes acceptance of those Terms to the extent permitted by law.
